Evidential review in cryptocurrency fraud case
Our investigative team received instructions from several London-based law firms to provide support for their clients who were awaiting trial in a complex crypto fraud case.
These individuals had been arrested years prior to our involvement and had consistently maintained their innocence.
The process
Our investigations team was provided with a comprehensive case summary, including supporting evidence and an in-depth analysis conducted by the prosecution.
Upon our initial review, it became evident which pieces of evidence the prosecution was relying on.
Our investigators were tasked with determining whether the prosecution’s investigative procedures had been conducted thoroughly and correctly.
After conducting a meticulous examination of the evidence, our expert criminal investigators meticulously dissected blockchain data and reconstructed the evidence that supported the prosecution’s case.
While it’s possible for two investigators to arrive at different conclusions, it was apparent that not all reasonable lines of inquiry to identify those responsible for the fraud had been pursued.
Additionally, issues with the chain of custody and the continuity of the illicit assets were identified.
The result
Our investigative team maintained an open and impartial stance, considering both the prosecution and defence perspectives.
Following our thorough review, it became clear that, on one hand, the prosecution’s case appeared robust. On the other hand, critical flaws were identified in the evidence, and not all reasonable lines of inquiry had been explored.
Consequently, after years of being on bail, the prosecution decided not to proceed with the case against one of the defendants.
Outcomes
- A comprehensive defence report completed within weeks.
- Prosecution offered no evidence after the client was on bail for several years.
- Reputation of the client was protected.
